http://www.RentCourtManager.diyrealty.co is a web property owned by North Star Realty, Inc. (NSR). NSR is not a law firm, and its employees are not acting as attorney’s for the CLIENT. North Star Realty, Inc. is a provider of online software and court administration services utilizing services of outsourced law firms. In jurisdictions where attorneys are required for Landlord Tenant cases, North Star Realty, Inc. provides only administrative and software services, leaving all legal representation to outsourced law firms.

AGREEMENT: Transactions by CLIENT constitutes agreement to published Terms of Use.

INTEREST ON UNPAID SUMS: Any sums due the NSR under any provision of transactions in perpetuity and not paid within thirty (30) days after such sums have been due, shall bear interest at the rate of eighteen percent (18%) per annum.

MUTUAL AGREEMENT RELEASE, WAIVER OF LIABILITY AND COVENANT NOT TO SUE: NSR shall be held harmless for any property damage or destruction that may result from the owners’ tenants. CLIENT further covenants and agrees that they will not sue NSR, its members individually, its officers, agents, or employees for any claim for damages, for bodily injury or other, arising while performing services for the CLIENT, except in the case of willful negligence. Both parties agree and understand that this release, waiver of liability, and covenant not to sue by either party shall remain in effect in perpetuity. Such time notification is submitted in writing by either party for their desire for revocation, will work or services no longer be applicable to this agreement.

RELATIONSHIP OF THE PARTIES: Nothing in this Agreement is intended to, or shall be deemed to, constitute a partnership or joint venture between the parties.

RESPONSIBILITY: NSR DOES NOT ACCEPT ANY OBLIGATIONS OR RESPONSIBILITIES NOR DOES IT OFFER ANY GUARANTEE OTHER THAN THOSE EXPRESSLY AGREED, NOT EVEN IN RELATION TO THIRD PARTY’S CLAIMS. NSR SHALL NOT BE RESPONSIBLE FOR ANY DAMAGE TO PROPERTY OR PERSONS. IF A THIRD PARTY CLAIMS ANY DAMAGE AGAINST ONE OF THE PARTIES OF THE CONTRACT, THIS PARTY SHALL IMMEDIATELY NOTIFY ALL REMAINING PARTIES OF THE CONTRACT IN WRITING. THE PARTIES SHALL MUTUALLY AGREE TO BE INVOLVED IN ANY LITIGATION OR ARBITRATION EXAMINING CLAIMS FOR DAMAGES AND OTHER RELIEF AGAINST ONE OF THE PARTIES FOR LIABILITY CLAIMS OR OTHER CLAIMS OF SIMILAR KIND. THE CLIENT SHALL INDEMNIFY, DEFEND AND HOLD HARMLESS NSR FROM AND AGAINST ANY THIRD PARTY CLAIMS FOR DAMAGES INCURRED UNDER CIRCUMSTANCES CONTROLLED BY THE CLIENT. NSR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES INCLUDING, BUT NOT LIMITED TO, LOSS OF RENT OR LOSS OF PROFIT OR DAMAGED CREDIT. THE MAXIMUM LIMIT OF NSR LIABILITY FOR DAMAGES AND LOSSES OF ANY SORT AND FOR WHATEVER REASON, RESULTING FROM OR IN ANY CIRCUMSTANCE CONNECTED WITH THE USE AND DELIVERY OF THE SERVICES, MAINTENANCE OR CONTRACTORS SUPPLIED BY NSR, SHALL BE IN THE FORM OF A CREDIT APPLIED TO THE AMOUNT OF THE TOTAL SUM OF THE CONTRACT VALUE AND SHALL NOT EXCEED THE TOTAL SUM OF CONTRACT VALUE. REGARDLESS OF ANY OTHER PROVISIONS OF THE GENERAL TERMS AND CONDITIONS STATED HEREIN, THE LIMITATION OF LIABLITIES SHALL NOT APPLY TO ANY BREACH OF PARTY IF THE PARTY HAS BEEN GUILTY OF INTENT OR GROSS NEGLIGENCE.

APPLICABLE LAW: The interpretations of this Agreement shall be governed by the laws of the State of Maryland.

REFUND POLICY: The transacting party hereby understands that transactions are NON-REFUNDABLE AFTER SERVICE IS RENDERED.  The CLIENT understands and agrees that any request for refund on a purchase must be written and made within four (4) hours of the time of their transacted purchase for refund eligibility; after which time Service shall have already been deemed as rendered and therefore ineligible for a refund.

EXPENSE OF COLLECTION: In the event that it shall become necessary for the NSR to institute collections proceedings against CLIENT for non-payment or for the violation of any other terms of conditions of this Agreement, NSR may assess and CLIENT agrees to pay all collection expenses of any amount claimed for the enforcement of any of the covenants of this Agreement plus court costs, private processing server fees, expense of litigation, NSR fees, and Legal fees actually incurred.

INDEMNIFICATION/HOLD HARMLESS: The transacting party does hereby irrevocably covenant, promise and agree to indemnify NSR and its principals and to hold them harmless from and against any and all losses, claims, expenses, suits, costs, demands, damages or liabilities, joint or several, of whatever kind or nature which CLIENT may sustain or to which he/she may become subject arising out of or relating in any way to this Agreement, including without limitation in each case attorney’s fees, costs and expenses actually incurred in defending against enforcing any such losses, claims, expenses, suits, damages or liabilities.

SEAL: The parties who transact a purchase on the site http://www.RentCourtManager.com are intended to establish this Agreement and any attachments or addenda under SEAL as evidenced thereof with purchased and any attachments or addenda thereto is intended to be a specialty and governed by the Annotated Code of Maryland, Courts and Judicial Proceedings, Article 5-102 (a)(5) as amended from time to time.

(NSR) Each such website is referred to in this privacy policy as a “Site.” In this privacy policy, we describe NSR’s practices for collecting, storing, using, and disclosing information that we may obtain through any of the Sites. Please note that by using or accessing any of our Sites, you consent to the collection, storage, use and disclosure practices described in this privacy policy.

Governing Law

Any dispute over privacy or other terms contained in this privacy policy will be governed by the law of the State of Maryland.
